Terms of Service

1. Acceptance of Terms

By accessing or using the Rexium AI platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of Service

Rexium AI provides an AI-powered customer support chatbot platform. The Service includes a dashboard for managing conversations, a knowledge base for training the AI, an embeddable chat widget, analytics, and team management tools.

3. Account Registration

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized access to your account.
  • You must be at least 18 years old to use the Service.

4. Subscription & Billing

  • All plans include a 7-day free trial. No credit card is required to start the trial.
  • After the trial period, you must subscribe to a paid plan to continue using the Service.
  • Subscriptions are billed monthly or annually, depending on your selection. Payments are processed through Stripe.
  • You can upgrade, downgrade, or cancel your subscription at any time from the Billing page. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice. Existing subscriptions are honored until renewal.

5. Usage Limits

Each plan has defined limits for conversations per month, team agents, websites, and knowledge base documents. If you exceed your plan limits, you will be notified and may need to upgrade. We do not charge overage fees — instead, the Service may restrict new conversations until the next billing cycle or until you upgrade.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Send spam, phishing, or misleading content through the chatbot
  • Upload malicious, illegal, or infringing content to the knowledge base
  • Attempt to reverse-engineer, decompile, or access the source code of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Resell or redistribute the Service without written authorization

7. Your Content & Data

  • You retain ownership of all content you upload (knowledge base documents, product data, FAQs).
  • You grant us a limited license to process your content for the purpose of operating the Service (e.g., generating embeddings, providing AI responses).
  • Conversation data between your visitors and the chatbot is stored on your behalf and treated as your data.
  • We do not use your data to train AI models for other customers or for any purpose beyond operating your account.

8. Intellectual Property

The Rexium AI platform, including its design, code, features, and documentation, is the intellectual property of Rexium AI. You may not copy, modify, or create derivative works based on the Service except as explicitly permitted.

9. Service Availability

We strive for high availability but do not guarantee 100% uptime. We may perform maintenance that temporarily affects availability. Enterprise plans include SLA guarantees as specified in separate agreements.

10. Limitation of Liability

To the maximum extent permitted by law, Rexium AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

11. Termination

  • You may terminate your account at any time from the dashboard or by contacting us.
  • We may suspend or terminate your account if you violate these Terms, with notice when possible.
  • Upon termination, your data will be retained for 30 days to allow export, then permanently deleted.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or dashboard notification at least 15 days before taking effect. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of Portugal. Any disputes shall be resolved in the courts of Lisbon, Portugal.
